Angus Moon QC represents Barts and The London NHS Trust in £1.4m Employment Tribunal claim against Barts in widely publicised whistleblowing case.

Angus Moon QC represented Barts and The London NHS Trust in Dr Otto Chan’s recent widely publicised “whistleblowing” claim against Barts. The Employment Tribunal decided that Dr Chan had not made his disclosures to the publication “Hospital Doctor”, the BMA and the Royal College of Radiologists in good faith and dismissed his £1.4 million claim against Barts. The case raised a number of legal issues including a novel issue on the meaning of s43C Employment Rights Act 1996. The Employment Tribunal was persuaded by Barts not to follow earlier suggestions by  the Employment Appeal Tribunal on this legal issue.  Please click here for a link to the full decision.
