George Hugh-Jones secures acquittal of doctor charged with twelve heads of dishonesty

George Hugh-Jones represented a doctor at the GMC last week and secured his acquittal on charges alleging twelve heads of dishonesty.  The charges were unusual in alleging that a principal GP on departure from his practice had dishonestly taken patient data (names and addresses) in order to contact them and introduce them to his new practice.    The allegations centred on breaches of the Data Protection Act 1998, partnership agreements and patient confidentiality.  After legal submissions and findings of fact, the GMC conceded that there was no case to answer in relation to misconduct, impairment or a warning.
