Gerry Boyle wins MDU High Court cancer trial

This was a tragic case involving allegations that a General Practitioner had failed to refer a young man for ultrasound examination for a suspicious testicular lesion. Gerry’s client, an MDU member, was of the view that the “lump” which the young man could feel was a benign abnormality which did not warrant referral. Around 2 years later the young man was diagnosed with testicular cancer and a peritoneal mass. In the summer of last year, as the prognosis was that the young man would not survive until trial, Gerry had to attend the young man’s family home for his evidence to be taken by way of deposition. The DVD footage of his evidence in chief and cross examination was played at the trial. Following a week long trial involving expert evidence from General Practitioners, Oncologists and Urologists Mrs Justice Cox dismissed the claim.
