Shortall v Chief Constable of Essex Police - Sarah Simcock successfully represented Essex Police in a claim for false imprisonment and assault arising out of an arrest to prevent a breach of the peace at Stansted airport in December 2003.
The Claimant had refused to show his passport at passport control and had become abusive to the Immigration Officer and later to the two police officers who attended, shouting and swearing at them. Having been asked to calm down he remained abusive and was subsequently arrested, handcuffed and taken to Stansted Police Station where he was de-arrested, having calmed down, and released. The judge commented in his judgment that “the officers acted in exactly the way I would have expected and hoped them to do”.
