Sports law specialist Tim Meakin, successfully defends the British Cycling Federation in a negligence claim.

A civillian cyclist was injured in a cycle collision in Surrey in 2008. The cyclist entered on to a public road that was part of a road race organised by the Surrey Cycling League. The claimant collided into the first defendant, who was a contestant, and both suffered serious injuries.

 

The claimant sued the first defendant, but also the British Cycling Federation, alleging it was negligent in the layout, administration and management of the race. The claimant maintained he saw no signs, or marshals when he unknowingly entered on to the road on which the race was taking place. In particular, he alleged the Federation had failed to provide sufficient marshals and signs indicating the presence of the road race.

 

The British Cycling Federation which was represnted by Tim Meakin, contested the allegations at trial before HH Judge Atkins at the Croydon County Court in June 2011. The judge held in favour of the British Cycling Federation and dismissed all allegations of negligence against it, with costs. He specifically held that the Federation had followed appropriate guidelines and that the administration and management of the event was properly undertaken.
