Angus Moon QC and James Berry in important duty of care and human rights case.

Angus Moon QC and James Berry recently acted for the NHS Trusts in a claim against the trusts for attempted murder by a psychiatric patient in the North East (Selwood [2011] MLR 213).

 The case raises the important question of whether NHS trusts owe a duty of care or a duty under the Human Rights Act 1998 to protect non-patients from harm. The claim was struck out by the Court, but the claimant is seeking permission to appeal to the Court of Appeal
