Nature of Practice

 

Police discipline: Stephen is instructed by a number of forces to appear on behalf of the Presenting Officer to prosecute disciplinary charges covering a broad spectrum of misconduct, neglect and honesty and integrity.  He advises on evidence and disclosure, drafts charges and also sits as a legal advisor to panels.

Reported and other cases of Interest

 

Mark Saunders shooting [2008-9] - Stephen represented the Metropolitan Police in the investigation into the fatal shooting of barrister Mark Saunders.

 

Warwickshire Police v PCs Cottingham and Hall [2007] - Stephen represented Warwickshire Police in this case, which was the first ever police disciplinary case to be held in public. On 3 February 2005 Colette Lynch was stabbed to death by her former partner, Percy Wright. Two days earlier Wright had smashed a window at Ms Lynch’s house, threatened to cut her throat and said he would return. PCs Cottingham and Hall were called to the incident but failed to take any positive action to protect her. The hearing found the two officers guilty of a breach of the Police Code of Conduct and fined them the equivalent of five days pay.
