Nature of Practice

 

Pravin developing an established practise in police law and has advised and represented a number of police forces in a variety of matters.

 

Civil Actions Against The Police
Pravin is regularly instructed to appear for forces throughout the country across the full range of civil actions brought against the police. He is adept at dealing with vexatious litigants in court and on paper. He is also able to advise at short notice. Pravin was recently instructed in respect of claims arising out of the latest London riots.


Civil Applications
Pravin has extensive experience in the range of civil applications made by police forces. He has appeared for forces on countless occasions in commonplace applications such as cash forfeitures under the Proceeds of Crime Act 2002 to more novel ones such as Risk of Sexual Harm Orders under the Sexual Offences Act 2003.


Disclosure and Information
Pravin has specific expertise in this area. He has appeared in the High Court on numerous occasions both in respect of applications for information from the police and requests by the police for disclosure. He is acutely aware of the sensitivities surrounding such cases. He has dealt with complex applications involving public interest immunity and submissions on the appropriate use of special advocates. He successfully represented Bedfordshire Police in In the matter of SJ (A Child) EWHC 473 (Fam). He was most recently invited to address the Association of Police Lawyers Spring Conference on the issue of the police and disclosure in family proceedings.

 

Human Rights
Pravin is well versed in claims with a human rights dimension. Article 6 and 8 issues commonly arise in civil applications such as closure orders and the restriction of information in disclosure applications. In addition Pravin has contributed to advice concerning Articles 10, 11 and 17 ECHR in respect of the right to protest.

 

Inquiries and Inquests
Pravin is available to provide representation and advisory work. He has experience of Article 2 inquests and is also familiar with inquires having been instructed by the Department of Health in the latest Stafford Inquiry.

 

Employment
Pravin is available for advisory work and representation across the range of employment disputes. He was most recently instructed in a week long hearing involving constructive dismissal made by a long standing officer.

 

Operational Advice
Pravin is available to provide operational advice that is not only legally sound but practically useful. This includes advice on legislation, case law and guidance.

Belcher v Essex Police – strike out of claim involving issues under the Data Protection Act 1998.
Kennedy v Hertfordshire Police – representation in respect of costs. The Claimant was ordered to pay 75% of the police’s costs apportioned on an “issues basis”. The claim itself involved allegations of misfeasance in public office and race discrimination (both unsuccessful).
Alexander v Metropolitan Police – trial involving alleged property damage following the execution of a section 8 warrant.
Franklin v Northamptonshire Police – complex claim for loss and damage to property giving rise to issues in conversion and bailment.
Saggers v Hertfordshire Police – claim for the delivery up of property under the Police Property Act 1897.

Avon & Somerset Police v Lawrence – appeal against a closure order in the Crown Court.
Metropolitan Police v Kuganathan - cash forfeiture involving money laundering through the telecoms industry.  
Humberside Police v Hussain – cash forfeiture involving drug dealing.
Thames Valley Police v Isaacson – sexual offences prevention order (SOPO) against a man charged with possession of child pornography who had worked in a nursery.
