Civil Applications
Oliver regularly represents various police forces around the country in the Crown, Family and Magistrates Courts in Proceeds of Crime Act (“POCA”) seizures and forfeitures, Anti-Social Behaviour Orders (“ASBOs”), Police Property Act matters, Forced Marriage Protection Orders (“FMPOs”), Sexual Offences Prevention Orders (“SOPOs”) and Risk of Sexual Harm Orders (“RSHOs”). 

 

Civil Actions against the Police
Oliver represents police forces in actions brought for personal injury and property damage following arrest and search of persons or searches of property. 

 

Operational Advice
Oliver has advised various Police forces on the application of new and changing legislation and various aspects of civil litigation including in relation to false imprisonment and malicious prosecution. 

 

Administrative & Constitutional Law
Oliver has a developing interest in all aspects of Administrative, Constitutional and Public law, including Judicial Review and Human Rights.  Through work in civil applications and operative advice, he has an in depth knowledge of wide ranging Police sectors.  Oliver advises the police on Constitutional Law matters and has represented various Police forces in the High Court, including defending actions brought under the Human Rights Act.

 

Disclosure Applications
Oliver acts for the Police in disclosure applications in the Crown and Family Courts where documents have been obtained as a result of Police investigations.

 

Licensing
Oliver represents police forces before Licensing Panels in matters concerning the Licensing Act 2003. 

 

Coroners’ Inquests
Oliver has significant experience of representating police forces at Inquests.

Reported and other cases of Interest

 

Southall v General Medical Council [2010] EWCA Civ 407; [2010] Fam Law 699; [2010] EWCA Civ 484; [2010] All ER (D) 24 (May).  Junior Counsel representing Dr Southall: successful appeal to the Court of Appeal from the High Court on the issue of inadequate reasons for findings. 

 

Edwards v Chesterfield Royal Hospital NHS Foundation Trust [2010] EWCA Civ 571; [2010] 3 WLR 1285; [2010] All ER (D) 247 (May).  Junior Counsel representing Mr Edwards: successful appeal to the Court of Appeal from the High Court on the issue of employee entitlement to contractual damages for breach of disciplinary procedures.  The Respondent has gained permission to appeal to the Supreme Court. The case is due to be heard in Summer 2011.

 

Oliver is currently instructed on behalf of Dr Southall as junior Counsel to Mary O’Rourke QC in General Medical Council v Dr David Southall before the GMC’s Fitness to Practise Panel.
