Nature of Practice

 

James has been appearing in the Employment Tribunals since his pupillage, when he successfully represented his first client through the Free Representation Unit. He acts for claimants and respondents from maintenance workers to large multinational corporations.

 

Contractual Disputes
Advising and representing parties in claims including unlawful deduction of wages.

 

Disciplinary Procedures

James has a particular interest in disciplinary procedures arising out of his complementary professional discipline practice.  James advises on the content disciplinary procedures and tactics in disciplinary investigations and represents parties in internal disciplinary investigations and hearings. 

 

Discrimination and Victimisation
Acting in claims for discrimination of all kinds including claims for victimisation and harassment.

Recent experience
Representing a leading London restaurant company defending claims of race discrimination, victimisation and harassment.
Representing a large Police Force defending a substantial claim for sex and age discrimination.

General Employment Advice
James is available to give general advice on employment policies and procedures.  Through his work in his other practice areas, James has an in-depth knowledge of the medical and police sectors and the special employment considerations that pertain.

Recent experience:

Advising on employment serveillance.

Advising on computer misuse policies.
 

Unfair and Wrongful Dismissal
James has acted for claimants and respondents in cases arising from the termination of employment including dismissal for gross misconduct and redundancy and constructive dismissal.

Recent experience:

Representing a clerical worker in a fruit distribution company made redundant while the employer was hiring new staff.

Representing a Building Society in a claim for unfair dismissal following an investigation into theft of money from the cash desk.

Representing a leading London private members club in an unfair dismissal and whistleblowing claim arising out of the misuse of members' confidential information.

James has advised and represented parties in claims involving whistleblowing.
