Nature of Practice

 

Police Discipline  Gerry is currently retained by a number of Forces to appear on behalf of the Presenting Officer to prosecute disciplinary charges covering a broad spectrum of misconduct, neglect and honesty and integrity including sexual harassment, death in custody, excessive use of force, fatal firearm operations, wrongful disclosure of sensitive information and corruption. He has considerable experience in advising on evidence and disclosure and the drafting of disciplinary charges. When not presenting cases, Gerry has acted as a Legal Advisor to disciplinary tribunals.

Civil Actions Involving the Police  Gerry specialises in the entire spectrum of civil proceedings involving the police and acts for many Police Forces throughout the country including the Metropolitan Police, West Yorkshire and Thames Valley. He regularly acts for Chief Constables in both jury and judge alone trials and has particular experience defending claims involving allegations of racism.
In addition to his trial work Gerry has advised in relation to all manner of civil claims including assault, false imprisonment, malicious prosecution, trespass to property (including the use of firearms during searches of domestic premises) and misfeasance in public office.

Judicial Review  Gerry has advised on the police response to applications for judicial review, settled statements and appeared on behalf of the police in judicial review proceedings.

Inquests and Public Inquiries  Gerry has acted on behalf of a number of forces at Coroner`s inquests into deaths of individuals who have had contact with the police, including as a result of detention in police stations, vehicle pursuit operations and arrest and restraint of a crack cocaine user. Earlier this year Gerry appeared at the Bichard inquiry an independent inquiry following the Soham murders.

Employment and Pensions  In the employment field Gerry has experience of acting in cases involving allegations of sexual discrimination and has advised in detail on the application of the Police Pension Regulations, in particular as a result of the amendments to the legislation which came into effect in July 2003.

ASBOs and Sex Offender Orders  Gerry has advised on and obtained Anti-Social Behaviour Orders and Sex Offender Orders on behalf of a number of forces.

Additional areas of police work  In addition to the usual claims that are made in civil proceedings Gerry has experience in dealing with applications under the Police Property Act, civil actions for wrongful interference with goods and bailment.

Gerry also specializes in professional negligence litigation (particularly medical) and personal injury law. He has a keen interest in medical disciplinary work and has appeared before the General Medical Council, the Society of Analytical Psychologists and the General Council of Chiropractors. During his early career Gerry prosecuted on behalf of the Crown Prosecution Service, the Vehicle Inspectorate and the Registry of Friendly Societies

Gerry is currently a member of the Standing Panel to Prosecute Cases before the Disciplinary Tribunals on behalf of the Professional Conduct and Complaints Committee of the Bar Council
