Nature of Practice

 

Clinical Negligence  Gerry has experience of a broad spectrum of clinical negligence claims acting on behalf of both Claimants and Defendants. He regularly receives instructions from NHSLA Panel Solicitors, the Medical Defence organisations and leading Claimant solicitors. Claims of interest have included the following:

General Practice  Delayed diagnosis of breast cancer complicated by fertility treatment and pregnancy, delayed diagnosis of sub-arachnoid haemorrhage, failure to act upon an abnormal smear report, failure to diagnose pregnancy!
Obstetrics & Gynaecology  Erb`s palsy, brain injury at birth, delay in delivery resulting in still-birth; negligent performance of a hysterectomy.

Midwifery  Failure to properly assess the commencement of established labour, excessive prescription of syntocinon, failure to properly interpret and act upon CTG traces.

Plastic surgery  Inadequate peformance of repeat breast enhancement surgery performed on a private basis.

General surgery  Delay in recognition of intra-abdominal bleed following cholecystectomy [removal of gall bladder] resulting in splenectomy and colostomy, inadequate pre-operative assessment resulting in nerve damage following laparotomy.

Orthopaedics  Delay in diagnosis of intradural spinal tumour resulting in permanent bilateral disability; failure to diagnose cervical spinal fracture following serious RTA, mobilising the spine causing nerve damage and paralysis.

Neurology  Delay in diagnosis of chiari malformation in a minor resulting in permanent disability.

Psychiatry  Over-prescription of anti-psychotic medication.

Professional Conduct and Performance  Gerry has a keen interest in all aspects of medical disciplinary work. At the General Medical Council he has appeared before the Interim Orders Panel, the FTP, the Committee on Professional Performance and the Assessment Referral Committee.
He has widened the scope of his disciplinary practice and has also appeared before the General Council of Chiropractors, the Society of Analytical Psychologists and the Health Professionals` Committee. Gerry also represents nurses before the Nursing and Midwifery Council.

Coroner`s Inquests  Gerry has considerable experience acting on behalf of medical practitioners, trusts and families at Coroners` Inquests. He has been involved in an inquest arising out of death following angioplasty whenthe Coroner recorded one of the first free-standing verdicts of `neglect` following the Court of Appeal in Middleton. He has acted on behalf of nurses following suicides in prison medical wings and mental health units in England and Wales.
