Cases involving health & safety and related issues George has extensive experience in acting for the Defence in health and safety prosecutions and for both Claimant and Defendant in the civil courts. Cases include: Appearing in the High Court in Judicial Review proceedings following the service of an improvement notice Acting for a defendant in a health & safety prosecution following a serious injury to an archaeologist during excavation works Acting for a large university prosecuted following the discovery of asbestos during remedial works which resulted in a worker suffering acute exposure to high levels of asbestos Acting for the dependents and estate of a university clerk of works killed on site by a runaway skip where the investigation conducted by the Health & Safety Executive had been inconclusive Acting for both employees and employers in accidents at work in agriculture and industry
Cases involving environmental and related issues George has acted as junior counsel for the Defendant in several threatened and effective prosecutions under the Environment Protection Act 1995. Classification, control and disposal of special waste. Inadequate and/or poorly controlled remediation of brownfield sites. One single threatened prosecution by the Environment Agency concerned the remediation of 3 separate sites in the South of England and the use of waste from one site as fill at other locations. Defending a national house builder in a prosecution under the Property Misdescriptions Act 1991 following inadequate remediation of a brownfield site.
