Nature of Practice

 

Police Law Overview

 

Edward advises and represents many of the police forces in the country in a wide variety of civil actions.  He has represented and/or is instructed by the police in both jury and judge-only trials and has acted in a variety of interim matters.  Edward has a particular interest in professional misconduct cases and has appeared as the presenting officer in police misconduct cases involving allegations of dishonesty and breach of confidentiality.  Furthermore, Edward has undertaken a wide range of general advisory work, including operational advice to police forces on matters such as the implementation of new legislation and the disclosure obligations in civil litigation.

 

Civil actions involving the police

 

Edward is often instructed to provide advice on civil claims involving police forces.  He is instructed and/or has appeared for the police in both jury and judge-only trials and has acted in many interim matters.  Edward has represented the police in trials involving allegations of assault, false imprisonment and damage to property.  He is often instructed to draft pleadings and frequently provides representation during strike out/summary judgment applications.

 

Advisory work

 

Edward has undertaken a wide range of general advisory work, including operational advice to several police forces on matters such as the implementation of new legislation and the disclosure obligations in civil litigation.  In addition, he has advised the Serious Organised Crime Association (SOCA) on the content and drafting of internal guidance handbooks.

 

Professional misconduct

 

Edward has considerable experience and a wide ranging interest in professional misconduct and regulation. He has experience of advising and representing professionals before their regulatory bodies and also of appeals of disciplinary and regulatory decisions.  Edward is regularly instructed to appear on behalf of the Presenting Officer at misconduct hearings under the Police (Conduct) Regulations 2008 and on appeal to the Police Appeal Tribunal.  He has appeared as the presenting officer in police misconduct cases involving allegations of dishonesty and breach of confidentiality.  Edward recently and successfully acted for a police force in a professional misconduct case which resulted in findings of gross-misconduct and immediate dismissal from the police force.

 

Independent Legal Advisor

 

Edward is often instructed to act as an independent legal advisor to panels.  Edward has recently acted as an independent legal advisor in a multi-officer police misconduct hearing under the Police (Conduct) Regulations 2008.

 

Inquiries and inquests

 

Edward specialises in inquest law.  He has acted for a variety of statutory bodies at inquests around the country.  Edward has particular interest in inquests held under Art 2 ECHR investigating deaths in police or prison custody.

 

Firearms Licensing

 

Edward often represents the police at Crown Court appeal hearings relating to firearms and shotgun licensing.  He has defended in numerous appeals concerning revocation following misbehaviour or criminal conviction.

 

Civil Applications in the Magistrates' Court

 

Edward has significant experience acting on behalf of the police in applications for Anti-Social Behaviour Orders, Sexual Offences Prevention Orders/Risk of Sexual Harm Orders, Notification Orders, Football Banning Orders, Closure Orders and orders under the Proceeds of Crime Act 2002.

 

Injunctions

 

Edward has considerable experience in advising and applying for injunctions under the Protection from Harrassment Act 1997.  Edward recently and successfully acted for Health Care Professionals and NHS Trusts in applications for interim and final injunctions.  He has also advised and represented commercial corporations in relation to the obtaining of injunctions.

 

Edward frequently acts in disclosure applications in the Family Courts and Crown Courts.  He represents police forces in cases in which it is necessary to assert confidentiality in relation to medical records, or documents created in the course of police investigation, or manage disclosure, such as those involving child abuse by a family member.

 

Employment

 

Edward also has experience of dealing with police employment issues, particularly where there is overlap with misconduct issues.

 

Judicial review

 

Edward has a developing public law practice with an emphasis on judicial reviews involving the police and other statutory bodies.
