Nature of Practice

 

Clodagh has extensive experience acting for police forces around the country, including Avon & Somerset, Bedfordshire, Cambridgeshire, Cumbria, Essex, Lancashire, Lincolnshire, Metropolitan, Norfolk, Northamptonshire, Nottinghamshire, South Wales, Suffolk, Sussex, Thames Valley, West Mercia and West Yorkshire Police. She has dealt with all aspects of police law including both jury and judge only trials and she has represented the police in a variety of interim matters including strike outs and PII applications.

Civil actions involving the police

Clodagh has represented various forces in many civil actions and is experienced in drafting statements of case and advising in relation to all kinds of civil claims ranging from neighbour disputes through to major public order incidents (including animal rights protests, football hooliganism, etc).
Inquests  

Clodagh has a wealth of experience of coroner's inquests, especially with a medical or custodial context.  She has appeared on behalf of families, doctors, NHS Trusts, the police and the prison service as interested persons.  Many of her cases have included controversial ethical issues such as the withholding of treatment from elderly patients, proceeding with high risk transplant surgery, deaths of psychiatric patients and childbirth related maternal and perinatal deaths.  Clodagh appeared on behalf of the police in the inquest and judicial review proceedings arising out of the death of Roger Sylvester: R v Anderson ex p HM Coroner for Inner North London.

Mediation  

Clodagh has represented litigants in mediations in civil actions against the police and other claims, both in formal meetings with a mediator and in ‘round table discussions’.

Judicial review

Clodagh has experience of judicial review proceedings arising out of inquests and has also appeared in judicial review proceedings relating to the discharge of a police officer accused of sexual misconduct.

R v Anderson ex p HM Coroner for Inner North London [2004] EWHC 2729 (Admin) – death of Roger Sylvester in a psychiatric hospital following restraint by police.  Verdict of unlawful killing quashed as coroner’s direction to jury on causation so confusing as to render verdict unjust.

Other experience  Clodagh has also dealt with police disciplinary matters and has acted for the police in relation to issues arising out of the Police Pensions Regulations 1987.

Clodagh has received basic training and used a variety of police firearms at firearms training centres (including a sawn off shotgun!). She also spent a Friday nightshift with Hackney officers to get a flavour of the operational side of officers’ work.
