Nature of Practice

 

Clinical negligence  Specialist in the field acting for both claimants and defendants. Wide experience in trials and in hearings in the appellate courts, including the recent decision of D v East Berkshire Community NHS Trust - the House of Lord`s decision on doctors` duties of care in relation to diagnoses of child abuse. Angus has particular expertise in group actions, having been instructed in the Ledward group litigation and as a silk in continuing group litigation in the clinical negligence field. Angus is the current editor of the Lloyds Law Reports: Medical.

Disciplinary  Considerable experience before disciplinary tribunals including the General Medical Council – and in advising on judicial review relating to such tribunals. Prosecutes and defends before the Family Health Service Appeal Tribunal. Counsel to the authority in Kataria v Essex Strategic Health Authority [2005]. Prosecuting counsel in Karwal v Medway PCT [2005]. Defence counsel in Doshi v Southend-on-Sea PCT [2007] and Rauniar v Waltham Forest PCT [2007].

Judicial review  Considerable experience in judicial review in the medical field, in particular in relation to decisions of the Secretary of State, Trusts and Health Authorities as to ethical and disciplinary matters. Particular interest in applications in the Administrative Court in relation to the General Medical Council.

Employment  Considerable experience in employment issues. Instructed as leading counsel in relation to employment injunctions and declarations in the High Court. Expertise in group litigation in the employment field. Counsel to Mr Skidmore in the House of Lords’ recent decision on the difference between personal and professional misconduct in HC (90)9: Skidmore v Dartford & Gravesham NHS Trust [2003] UKHL 27 (the difference between personal and professional misconduct). Acted for Trusts and doctors in unfair dismissal and discrimination proceedings in the Employment Tribunal. Counsel to the Trust in one of the first “whistleblowing” claims under the Public Interest Disclosure Act 1998. Counsel to the trust in Chan v Barts Hospital [2007] relating to declarations in the High Court.

Medical Ethics  Instructed in cases involving medical ethical questions, especially those involving children. Numerous reported decisions in the field. Counsel for the General Practitioner in the application to the President of the Family Division by the late Annie Lindsell, the supporter of voluntary euthanasia. Author of Her Majesty’s Stationery Office publication “The Treatment of Children.” Counsel to the GP in the recent decision of the Court of Appeal as to the confidentiality of medical records (A Health Authority –v- X).
