Nature of Practice

 

Employment and Labour Law  Considerable experience in all aspects of employment claims in the High Court,  Employment Tribunals and other tribunals. Particular interest and experience in claims involving injunctive relief including claims for injunctions relating to disciplinary procedures. Instructed both by Claimants and Respondents in Employment Tribunals in unfair dismissal and discrimination proceedings. Instructed in “whistleblowing” claims under the Public Interest Disclosure Act 1998.

 

Considerable experience and expertise in disputes and advisory work involving the Human Rights Act 1998, the European Convention of Human Rights and the Data Protection Act 1998.
 
Expertise in employment and disciplinary tribunals involving doctors and other professionals. Represents both doctors and health trusts in internal disciplinary procedures and litigation involving allegations of misconduct. Counsel to the Claimant in the House of Lords’ recent decision relating to professional misconduct in Skidmore -v- Dartford & Gravesham NHS Trust.
 
Acts for parties engaged in mediation and alternative forms of dispute resolution.Considerable experience in judicial review, in particular in relation to decisions of the Secretary of State, and of appearing before disciplinary tribunals including the General Medical Council and the Family Health Service Appeal Tribunal.

Chan v Barts & the London NHS Trust, High Court, 18th December 2007 and Employment Tribunal, 19th January 2010.  High Court decision relating to employee's rights of appeal and subsequent £1.4 million "whistleblowing"claim in the Employment Tribunal. 

Kircher -v- Hillingdon PCT [2006] LS Law Medical 215, High Court, 13th January 2006. High Court decision relating to the employee’s right to obtain an interim injunction requiring the employer to adopt a disciplinary procedure prior to dismissal.

Skidmore -v- Dartford & Gravesham NHS Trust [2003] ICR 721. House of Lords’ decision relating to the contracts of employment of hospital consultants and the disciplinary procedure incorporated into such contracts.

P -v- Wozencroft (Expert Evidence: Data Protection) [2002] 2 FLR 1118. Decision relating to claims for access to and rectification of data under the Data Protection Act 1998.

Bhanot -v- South West London & St George’s [2000] Lloyd’s Law Rep: Med 324. High Court decision relating to the disciplinary procedure the employer should adopt.

Reynolds -v- The Health First Medical Group [2000] Lloyd’s Law Rep: Med 240. Decision as to whether patients have contracts with NHS general practitioners.

B -v- H Trust, 29th November 2000. One of the first decisions under the “whistleblowing” legislation, the Public Interest Disclosure Act 1998.

R v Milling ex parte West Yorkshire Police Authority [1997] 8 MLR 392. High Court decision relating to judicial review of decision under the Police Pensions Regulations.    

      

Walford -v- Miles [1992] 2 A.C. 128. House of Lords’ decision as to the enforceability of ‘contracts to negotiate.’
